Tolkien Estate and HarperCollins are suing The Saul Zaentz Company and Warner Bros. Tolkien Estate alleges that the companies are merchandising beyond the bounds of what was agreed in the 1969 deal with the studio and rights holder Saul Zeantz.
“The original contracting parties thus contemplated a limited grant of the right to sell consumer products of the type regularly merchandised at the time (such as figurines, tableware, stationery items, clothing and the like). They did not include any grant of exploitations such as electronic or digital rights, rights in media yet to be devised or other intangibles such as rights in services,” says the 26-page complaint. At the beginning of August, TheOneRing.net reported on allegations by a former animal wrangler that “incompetence” lead to the deaths of several animals used in the production while they were being housed at a farm outside of Wellington.
Now, The Associated Press has spoken with three other wranglers who said the farm near Wellington was unsuitable for horses because it was peppered with bluffs, sinkholes and broken-down fencing. They said they repeatedly raised concerns about the farm with their superiors and the production company, owned by Warner Bros., but it continued to be used. Warner Brothers has kicked off their Awards Season website for many of their films, The Hobbit: An Unexpected Journey among them. The page links to the Official Website and trailer, gives a brief synopsis of the story, and then lists all the names of the people who worked in eligible categories, from the Writers to the Sound Effects people, and a few of the actors. And just as a tease, there is a list of screenings, but those screenings are for Academy voters and members of the various Guilds (Screen Actors, Writers, Directors, etc) only. Fairfax NZ News reports official papers show that Tourism NZ sought approval from Warner Bros for every aspect of its $10 million “Middle-earth” marketing campaign — even checking with the film studio over issues that did not directly concern it. The documents, released under the Official Information Act, reveal the extent of the company’s sway over the government agency’s “100% Pure Middle-earth” marketing strategy, as well as the influence of Peter Jackson’s Wingnut Films. The latest edition of The Hollywood Reporter contains an article all about the upcoming Hobbit movie. Interestingly, the headline calls the films a ‘$1 Billion Gamble’ – though the coming success of the movies doesn’t seem to be a question in the minds of most fans! This latest article doesn’t tell us anything new, but it’s a pretty good summary of the journey so far; and of course, it mentions TORn. There’s no Hobbit’s Tale without a touch of TORn…. 🙂
UPDATE – and there are some pretty amazing images along with the article, including a photograph of Peter Jackson with a caption where he comments of Del Toro’s work on the movies, ‘Some of the things he did I certainly liked and took bits and pieces from it.’ Is this what we’re seeing in the ‘Del Toro-esque’ Dol Guldur orcs, such as Bolg and Yazneg, with their victims’ faces sewn into their clothing?? In another image, there’s a wonderful sketch of a dwarf seated beneath a tree, with runes below which read, ‘Supplies of pipeweed are running desperately low. If we do not find some very soon one of our few remaining pleasures will be a thing of the past.’ Could this be a note made by Ori, in the book we see him carrying around?
